New Jersey Family Leave Act
The New Jersey Family Leave Act (“NJFLA”) is a New Jersey State Law that was enacted to protect the economic security of family units. Covered employees cannot be fired by their employers for making use of this law.
Who is covered
According to the law, covered employees are those who work for employers with 50 or more employees, have been working there for at least 12 months, and have worked for at least 1,000 total hours throughout that period. Covered employees are entitled to take up to 12 weeks of unpaid, protected family leave, upon advance notice to the employer in a 24-month period.Employers can require that employees provide medical certifications as proof of the leave.
Examples of how the law can apply
If an employee has a family member with a serious health condition, the NJFLA provides that the employee can take leave for a block of time or intermittently when medically necessary.When a newborn arrives, a family member faces a serious illness, or in the case of foster care placement or adoption, employees shouldn't have to choose between their job and their family responsibilities. New Jersey's Family Leave Act provides crucial protections during these challenging times.
